As you know, the player has the flag stateflags and it has 1 flag, when inventory or cheat is open - can I check if the inventory is active or cheat without RB?

The only totally OBSOLETE modes of detecting a player's hack menu on a non-RB server are:

1- Using Advanced Tester which, from my point of view, is obsolete: http://fougerite.com/resources/advancedtester-recoiltest-jumptest.126/
2- Requesting the player a screenshot.
